These Terms and Conditions (“Terms”) apply to the use of the website www.comfortway.ca (the “Site”) and the services provided by ComfortWay Plumbing, Heating and Cooling (“ComfortWay,” “we,” “our,” or “us”). By accessing or using the Site or purchasing our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.
1. Scope & Acceptance
- These Terms form a legally binding agreement between you (“you” or “Customer”) and ComfortWay.
- Use of the Site or engagement of services indicates your acceptance.
- If you do not agree with any part of these Terms, please refrain from using the Site or purchasing services.
2. Services Overview
- ComfortWay offers plumbing, heating, and cooling services as described on the Site.
- We reserve the right to modify, suspend, or discontinue services at any time. Any material changes will be communicated to you in advance.
3. Service Orders & Confirmation
- Service orders may be placed via the Site, by phone, or via other communication channels.
- A service order becomes confirmed once we provide a confirmation (e.g. email or phone notification) detailing the scope, pricing, and scheduled service.
4. Pricing & Payment
- Prices listed on the Site are in Canadian dollars and are subject to change without notice.
- Payment is due as stated in the service confirmation. Unless otherwise specified, full payment is due upon completion of services.
- Late payments may incur interest or fees. ComfortWay reserves the right to suspend further service until outstanding balances are settled.
5. Cancellation & Rescheduling
- Customers must provide at least 24 hours’ notice to cancel or reschedule a service.
- Cancellations made with sufficient notice may avoid fees. Cancellations with less notice or missed appointments may incur a cancellation or rebooking fee.
6. Returns, Refunds & Warranties
- As a service provider, ComfortWay does not sell products through the Site. Any product installations follow the manufacturer’s terms.
- Services are performed with reasonable care and skill. If you are unsatisfied, contact us promptly—we will work to resolve any issues.
7. Limitation of Liability
- Subject to applicable law, ComfortWay, its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising from service provision or use of the Site—even if advised of the possibility.
- Our total liability for losses under these Terms shall not exceed the amount you paid us for the affected service.
8. Governing Law & Dispute Resolution
- These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada.
- Any disputes shall be resolved through informal negotiation. If unresolved, mediation or arbitration may be pursued prior to any litigation, in line with Ontario’s legal framework
9. Intellectual Property
- All content on the Site—including text, images, logos, and designs—is owned by or licensed to ComfortWay and protected by copyright and trademark law.
10. Third-Party Links
- The Site may contain links to third-party websites or resources. We are not responsible for their content or practices. Visiting those links is at your own risk. Please review their own terms and privacy policies.

12. Changes to Terms
